Privacy Notice

This Privacy Notice describes how After We Play, LLC (“After We Play,” “we,” or “us”) collects, uses, and discloses personal information through the After We Play platform, community, courses, and related services (the “Services”). It applies to athletes, coaches, staff, and the parents or guardians who use the Services, wherever they live in the United States. We apply one standard to every user’s personal information rather than varying our practices by state.

“Personal information” means information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual or household. Personal information does not include publicly available information or information that is de-identified or aggregated.

1.Personal Information We Collect and How We Use It

The table below describes the categories of personal information we collect, whether we collect each category, the purposes for which we use it, the categories of recipients to whom we disclose it, and how long we keep it. We collect this information from you, from the sports organization that enrolls you, and automatically as you use the Services. We do not collect precise geolocation information.

2.Sensitive Personal Information

Because the Services relate to mental health and wellness, some personal information you share is sensitive personal information. We process sensitive personal information only with your opt-in consent (or, for a user under 18, the consent described in Section 5), and we use it only to provide the Services. We do not use sensitive personal information for advertising, we do not sell it, and we do not disclose it except to service providers who help us provide the Services. You may withdraw your consent at any time as described in Section 8. When you complete an assessment or similar feature, we store your individual responses under a unique identification code rather than your name, so we can track your results over time while limiting who can link them to you; the enrolling organization and its coaches do not see your name associated with your individual answers or scores, and we keep the key that connects the code to your identity access-controlled and separate from your responses.

3.Sources and Purposes

We collect personal information from you, from the sports organization that enrolls you, and automatically as you use the Services. We use personal information to:

  1. (a)provide and maintain the community, courses, and content;
  2. (b)create and administer accounts and communicate with you;
  3. (c)keep the Services safe and moderate the community;
  4. (d)improve and support the Services; and
  5. (e)comply with the law.

4.How We Disclose Personal Information; No Sale or Sharing

We disclose personal information to service providers that process it for us under contract (for example, our platform infrastructure provider), to the sports organization that enrolled you, and when we reasonably believe disclosure is necessary to comply with the law or to protect a person’s safety. We do not sell personal information, we do not share it for cross-context behavioral advertising, and we do not use it for targeted advertising. Because we do not engage in those activities, there is nothing for you to opt out of for the sale, sharing, or targeted-advertising of your personal information.

5.Users Under 18

The Services are for users 13 and older, and we do not knowingly collect personal information from a child under 13. Because our users include minors, we obtain consent for a user under 18 from the user’s parent or legal guardian, or from the enrolling sports organization acting with the parent’s or guardian’s authorization, before we collect the minor’s personal information or process the minor’s sensitive personal information. For every user under 18, we do not sell personal information, use it for targeted advertising, or profile the user for decisions that produce a legal or similarly significant effect, and we limit the information we collect to what the Services need. A parent or legal guardian may exercise the minor’s privacy rights.

6.Tracking Technologies

We do not use tracking technologies, such as pixels, tags, or advertising APIs, to disclose sensitive personal information or a user-under-18’s personal information to a third party for advertising, retargeting, or marketing.

7.Data Minimization and Retention

We collect only the personal information the Services need, and we keep personal information only as long as we need it to provide the Services and for the periods the law requires. When we no longer need it, we delete or de-identify it.

8.Your Privacy Rights

Depending on where you live, you may have the following rights. We honor these rights for every user, regardless of state:

  1. (a)Access to know and receive a copy of the personal information we hold about you.
  2. (b)Deletion to ask us to delete personal information we collected from you.
  3. (c)Correction to correct inaccurate personal information.
  4. (d)Withdraw consent to withdraw your consent to our processing of your sensitive personal information at any time.
  5. (e)Opt out of profiling to opt out of profiling that produces a legal or similarly significant effect, if we ever conduct it.
  6. (f)No discrimination to exercise a right without our denying you the Services, charging you a different price, or providing a different level of service.
  7. (g)Appeal to appeal our denial of a request. We describe how to appeal in Section 9.

9.How to Exercise Your Rights

You, or an authorized agent acting for you, may submit a request at [email protected] or our contact form. For a user under 18, a parent or legal guardian may submit the request. We will verify your identity before we respond, and we will respond within the time the law requires. If we deny your request, you may appeal by contacting us at [email protected]; we will inform you of our decision on the appeal and the reasons for it. We also honor a recognized universal opt-out preference signal, such as Global Privacy Control, that your browser or device sends.

10.Security

We maintain administrative, technical, and physical safeguards designed to protect personal information. No system is perfectly secure, so we cannot guarantee absolute security.

11.Changes to This Notice

We may update this Notice from time to time. We review it at least once every twelve (12) months. We will post the updated Notice with a new effective date and, for a material change, we will give you notice.
